Terms of Use & Prescription Transfer Service Terms

These Terms are a binding agreement between you and A&A Med Solutions LLC d/b/a A&A Family Pharmacy (“A&A Family Pharmacy,” “we,” “us,” or “our”). By using aafamilypharmacy.com (the “Site”) or submitting a Prescription Transfer request, you agree to these Terms. If you do not agree, do not use the Site.
Section 1 — Website Terms of Use
1.1 Acceptance
By accessing or using the Site, you agree to these Terms, our Website Privacy Policy, and our Notice of Privacy Practices (for PHI). If you do not agree, exit the Site.
1.2 Eligibility
The Site is intended for users 18 years of age or older, or minors using the Site with the involvement of a parent or legal guardian. If you are under 18, you may use the Site only with such involvement.
1.3 Intellectual property
All content on the Site — text, graphics, logos, photography, the “A&A Family Pharmacy” name and logo, layout, and code — is owned by A&A Family Pharmacy or its licensors and is protected by U.S. and international intellectual-property laws. You may view and print pages for personal, non-commercial reference only. You may not reproduce, modify, distribute, or create derivative works without our prior written consent, except as expressly permitted.
User-submitted content license. If you submit content to us (testimonials, reviews, messages, or form text), you grant us a worldwide, royalty-free, non-exclusive, perpetual license to use, reproduce, and display that content in connection with operating the pharmacy and the Site, subject to our Notice of Privacy Practices for any PHI component.
1.4 Acceptable use
You agree not to:
- scrape, crawl, harvest, or otherwise copy Site content except via standard search-engine indexing;
- reverse engineer, decompile, or attempt to extract source code;
- interfere with, probe, or disrupt the Site's security or performance;
- upload or transmit viruses, malware, or malicious code;
- impersonate another person or misrepresent your affiliation;
- use the Site to violate any law, regulation, or third-party right.
1.5 No medical advice
The Site provides general information about A&A Family Pharmacy's services. It is not medical, pharmaceutical, diagnostic, or treatment advice. Nothing on the Site is a substitute for consultation with a licensed pharmacist, physician, or other qualified health-care professional. Always read medication labels and patient information carefully and speak with our pharmacist about your specific situation before starting, stopping, or changing any medication.
1.6 No pharmacist–patient relationship created
Visiting the Site, reading content, or submitting a form does not create a pharmacist–patient relationship. A pharmacist–patient relationship arises only when A&A Family Pharmacy accepts a prescription and dispenses medication to you in accordance with Florida law.
1.7 No emergency use
If you are experiencing a medical emergency, call 911 immediately. Do not use the Site, the Prescription Transfer form, email, or social media for emergencies or urgent medication needs. If you need medication urgently, call the pharmacy at (954) 987-5230 during business hours.
1.8 Third-party links
The Site may link to third-party websites (for example, Google Maps or health-information resources). We do not control and are not responsible for those sites or their content. Clicking a link takes you to a third party under its own terms and privacy practices.
1.9 Disclaimers of warranty
THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. WE DO NOT WARRANT THAT THE SITE IS FREE OF VIRUSES OR THAT ERRORS WILL BE CORRECTED.
1.10 Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY FLORIDA LAW, A&A FAMILY PHARMACY, ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATING TO YOUR USE OF THE SITE. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID US FOR SITE ACCESS IN THE PRECEDING TWELVE MONTHS, WHICHEVER IS GREATER.
Nothing in this section limits liability that cannot lawfully be limited, including claims for gross negligence, willful misconduct, or violations of applicable pharmacy or consumer-protection laws.
1.11 Indemnification
You agree to indemnify and hold harmless A&A Family Pharmacy from third-party claims arising out of (a) your violation of these Terms, (b) your violation of applicable law, or (c) your misuse of the Site.
1.12 Governing law and venue
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. The exclusive venue for any action is the state or federal courts located in Broward County, Florida, and you consent to personal jurisdiction there.
1.13 Dispute resolution
Informal resolution first. Before filing any claim, contact us at the information in section 1.18 and give us 30 days to resolve the matter informally.
Arbitration option (not currently elected). The pharmacy has chosen not to require binding arbitration at this time. Consumer arbitration clauses shift disputes out of court, usually on an individual (not class) basis; they can reduce litigation costs but also limit discovery, appeal rights, and jury trial. The pharmacy has weighed these tradeoffs and elected to preserve your right to bring an individual action in Broward County, Florida courts, and to pursue applicable regulatory remedies (Florida Board of Pharmacy, HHS OCR, Florida Attorney General). If the pharmacy adopts an arbitration clause in the future, it will be by notice and prospective update to these Terms.
1.14 Severability
If any provision of these Terms is held unenforceable, the remaining provisions remain in full effect.
1.15 Entire agreement
These Terms, together with the Website Privacy Policy and the Notice of Privacy Practices, are the entire agreement between you and us with respect to the Site.
1.16 Changes
We may update these Terms. Material changes take effect 30 days after we post the updated version and update the “Last updated” date. Your continued use after that date constitutes acceptance.
1.17 No waiver
Our failure to enforce any provision is not a waiver of that provision.

Section 2 — Prescription Transfer Service Terms
These terms apply specifically when you submit a request through the Prescription Transfer form on the Site. They are in addition to the Website Terms of Use above and to our Notice of Privacy Practices.
2.1 What the service is
The Prescription Transfer service lets you request that A&A Family Pharmacy contact another pharmacy to request the transfer of your existing prescription(s) to us, and where appropriate, contact the prescriber for refill authorization. Submitting the form is a request; it does not guarantee that a transfer will occur or that medication will be available on any particular date.
2.2 Who may use the service
You may submit a request only if you are (a) the patient, and at least 18 years old, or (b) the patient's parent, legal guardian, or legally authorized representative (for example, under a health-care power of attorney, or on behalf of a minor in your care). By submitting the form, you represent that you have the authority to act for the patient.
2.3 Authorization you grant by submitting
By submitting the form, you expressly authorize A&A Family Pharmacy to:
- contact the prior pharmacy identified in your request and receive the prescription and related medication-history information necessary to fill your prescription;
- contact the prescribing provider to request new prescriptions or refill authorization as needed;
- use and disclose the information you provide for purposes of treatment, payment, and health-care operations as defined under HIPAA and described in our Notice of Privacy Practices.
This authorization is consistent with a permitted pharmacist-to-pharmacist disclosure under HIPAA (45 CFR §164.506) and applicable Florida pharmacy law.
2.4 Accuracy attestation
You certify that the information you provide — patient identity, medications, prescription numbers, prescriber details, and insurance — is true, accurate, and complete to the best of your knowledge. False or misleading information may result in denial of the request, dispensing delays, or medication errors, and may violate law.
2.5 Electronic communications consent
You consent to be contacted by A&A Family Pharmacy by phone, voicemail, email, and/or text message at the contact information you provide, regarding your transfer request, refill status, insurance questions, and medication counseling. Standard message and data rates may apply. You may opt out of non-essential texts by replying STOP or contacting the pharmacy; clinical communications necessary for your care may continue consistent with HIPAA. Handling of PHI in these communications is governed by the Notice of Privacy Practices.
2.6 What happens after you submit
Non-controlled prescriptions:we typically process transfer requests within 1–2 business days. Timing depends on the prior pharmacy's responsiveness, refill availability, insurance verification, and our pharmacist's professional review.
If your prescription is out of refills, we will contact the prescriber for new authorization — which may take additional time.
If we cannot complete the transfer (for example, the prior pharmacy cannot confirm the prescription, refills are exhausted, or the medication is unavailable), we will notify you using the contact method you provided.
2.7 Controlled substances
Federal and state law restrict the transfer of controlled substances:
Schedule II (for example, certain ADHD stimulants, opioid analgesics): may be electronically transferred only once, for the initial fill, between DEA-registered pharmacies (21 CFR §1306.08). Schedule II prescriptions cannot be refilled; each fill requires a new prescription from the prescriber.
Schedules III, IV, and V: the remaining refills on an original prescription may be transferred only once for the life of the prescription (21 CFR §1306.25).
Florida law and pharmacist professional judgment may impose additional restrictions. If your request involves a controlled substance and cannot be transferred, we will contact you and, where appropriate, work with your prescriber on a new prescription.
2.8 Not an emergency service
Do not use this form if you need medication urgently. Call the pharmacy at (954) 987-5230 during business hours, or call your prescriber or 911 for emergencies.
2.9 Insurance coverage not guaranteed
Submitting a transfer request does not verify or guarantee insurance coverage, copay, or prior-authorization status. Insurance eligibility is confirmed separately when we attempt to adjudicate your claim.
2.10 Right to decline
A&A Family Pharmacy reserves the right, in our pharmacist's professional judgment and consistent with law, to decline any transfer request — for example, because of a suspected drug-therapy problem, inability to verify the request, regulatory restriction, or medication unavailability. If we decline, we will notify you.
2.11 Data handling
- Protected Health Information you provide (medications, prescriber, diagnoses, insurance, etc.) is handled under our Notice of Privacy Practices.
- Non-PHI website data surrounding your submission (timestamp, IP address, browser user-agent, general device information) is handled under our Website Privacy Policy.
- Our intake channel is configured to handle PHI through a vendor under a HIPAA Business Associate Agreement with encryption in transit and at rest.
2.12 Revocation / cancellation
To cancel a pending transfer request, call the pharmacy at (954) 987-5230 as soon as possible. Cancellation is effective when we receive your request; actions taken by us or the prior pharmacy before we process the cancellation cannot be undone.
